Collaborative and Medical Director Agreements in Colorado

A medical director or collaborative agreement should clearly explain the work each professional will do and how the arrangement will function in practice.

Drafting and review for your Colorado practice

I draft and review these agreements for Colorado healthcare practices and professionals. The starting point is the relationship itself: the services involved, the authority and responsibilities of each person, and the professional requirements that apply.

Define the role before drafting the terms.

The title “medical director” can describe different responsibilities in different settings. The agreement needs to reflect what the clinician will actually do, rather than leaving important expectations to assumptions.

I help clients examine the proposed role and address the terms that need to be documented. Depending on the arrangement, questions may include:

  • Who makes clinical decisions and evaluates patients?
  • Which services and professionals fall within the arrangement?
  • Who is responsible for prescribing, delegation, consultation or oversight when applicable?
  • What availability and communication does the practice need?
  • Who maintains clinical policies and relevant documentation?
  • How will the parties respond when a clinical or operational concern arises?

These questions help establish whether the proposed terms match the work and professional responsibilities involved.

Medical director agreements for med spas

In an aesthetics practice, the agreement should be considered alongside the treatments offered, the qualifications of the people delivering them and the practice's ownership structure.

I can review how the proposed medical director role fits those arrangements and draft or review the relevant agreement. The legal analysis may also involve delegation, clinical decision-making, compensation and patient disclosures.

Appointing a medical director does not, by itself, resolve ownership or scope-of-practice questions. Those issues need to be considered on their own facts and addressed consistently across the practice.

For the broader service, see Colorado med spa legal guidance.

Collaborative arrangements between healthcare professionals

A collaborative relationship should be described with enough detail for each person to understand the responsibilities they are accepting. The relevant requirements depend on the professions and services involved.

For nurse-led practices, it is important to distinguish the professional's actual credential, the services being offered and any prescribing, consultation or delegation questions. Different nursing roles and different practice models may call for different arrangements.

I help assess the proposed relationship and the documents needed to reflect it. The title of an agreement cannot expand a person's licensed authority or replace an arrangement required by law.

Terms to consider in drafting or review.

Duties and clinical authority

The agreement should explain the services covered, the responsibilities of the parties and how clinical decisions will be made. Any delegation, consultation or oversight terms need to fit the applicable professional framework.

Availability and communication

The parties should understand when and how they will communicate, what availability the role requires and how concerns will be addressed. The agreement should reflect a practical arrangement they can carry out.

Documentation and policies

The documents may need to address responsibility for clinical policies, relevant records and the documentation of agreed activities. The wording should be consistent with the practice's actual processes and the professional duties involved.

Compensation and insurance

Payment terms should identify the work being compensated and how fees will be calculated and paid. Depending on the arrangement, compensation can raise questions about professional-practice restrictions, fee splitting or referrals. Insurance responsibilities also need to be clearly understood and reviewed in context.

Termination and transition

An agreement should address how the relationship may end and the responsibilities that continue afterward. Notice, access to relevant records, unfinished obligations and continuity of the practice's clinical arrangements may all need consideration.

Review a proposed agreement or update an existing one.

AGREEMENTS

You may be considering a new role, reviewing a contract supplied by another party or revisiting an arrangement after the practice has changed. I can help assess the terms and identify issues relevant to your position.

At the outset, we clarify who I would represent and the scope of the work. A lawyer's review for one party should not be assumed to provide legal advice to everyone involved in the agreement.

If the arrangement is part of a new practice, practice startup services can help address the wider legal decisions. For patient-facing documents and other related forms, see regulatory forms and agreements.

Questions about medical director and collaborative agreements.

AGREEMENTS

Does every healthcare practice need a medical director agreement?

The answer depends on the profession, services and clinical arrangement. A medical director role should be assessed in that context rather than assumed to be required for every practice or sufficient for every legal issue.

Can I use the same agreement as another practice?

A document may address responsibilities that do not fit your services, providers or operating model. The terms need to be assessed against the actual relationship and applicable Colorado requirements before you rely on them.

When should an existing agreement be reviewed?

A change in treatments, professional responsibilities, personnel, compensation or ownership can be a reason to review the agreement. It is also useful to seek advice before accepting a new role or agreeing to materially different duties.

I can't recommend Maureen enough; she truly is exceptional! I hired her a couple of years ago to help ensure my medical aesthetics practice (and psychiatry practice) was fully compliant, and she was absolutely invaluable. What I appreciated most was her ability to take complicated laws and regulations, explain them in a way I could truly understand, and then share that information with my staff so our entire team could stay on the same page. She helped me better understand scope of practice, delegation, compliance, and how to navigate the fact that laws and regulations in medicine are constantly evolving. Beyond her knowledge and expertise, Maureen is simply an incredible person. She has the sweetest demeanor, a genuine and pure heart, and is incredibly authentic. She is the kind of lawyer who will always tell you the truth, even when it may not be what you want to hear, and I value that immensely. 💗

I cannot recommend Maureen highly enough! I reached out to her while preparing to open my own family practice, and she has been an incredible resource throughout the entire process. What has impressed me most is her communication. Maureen is incredibly responsive and gets back to me quickly, which has been invaluable while navigating all of the moving pieces involved in opening a medical practice. I never feel like I’m left waiting or wondering what the next step is. She is thorough, knowledgeable, and always takes the time to answer my questions and explain things clearly. She has made the legal side of opening my practice feel so much less overwhelming, and I genuinely feel like I have someone in my corner. I’m extremely grateful I found Maureen and would absolutely recommend her to any healthcare professional or practice owner looking for a knowledgeable, responsive, and trustworthy healthcare attorney.

Maureen was incredibly helpful in setting up my women’s wellness clinic and making sure we had the right legal, compliance, and safety foundations in place from the start. She made a complicated process feel clear and manageable, and I appreciated how thorough and practical she was throughout. I also value that she has remained available as a resource for anything that comes up as the business grows. I would highly recommend her to anyone opening or operating a healthcare practice.

I haven’t worked with Maureen personally, but I’ve seen firsthand the impact of her work within the esthetics community. She played a key role in helping draft legislation in Colorado that supports medical spas and opens the door for estheticians to become owners, which is something that is incredibly meaningful to me and for all professionals in our field. From what I’ve observed, she is not only knowledgeable and skilled, but also genuinely supportive of estheticians and the growth of our industry. It’s rare to see someone advocate so strongly for a community they truly believe in. Her work is making a difference, and I’m grateful for the positive changes she’s helping bring about.
