Be Prepared for a board complaint

It takes only one disgruntled patient or employee to wreak terrible havoc on your med spa. A tactic frequently used by disgruntled individuals is to file a complaint against your license with the state regulatory board. Complaints against physicians, physician assistants, nurses, aestheticians, and other licensed providers are on the rise. Even if you have been fully compliant, responding to a regulatory board complaint can cause high stress, and is likely to incur expensive legal costs. Because it is the duty of regulatory boards to investigate each complaint, you must respond. Providing written evidence of OSHA, Infection Control, Informed Consents, and other types of documents that reflect compliance with federal and state laws is likely to be a critical factor in obtaining a favorable outcome.

By having well drafted documents that all providers in your med spa are expected to be follow is one important way to ensure that the standard of care for each procedure is consistently met. Regular internal audits are an excellent way to identify inconsistencies that may be occurring amongst providers. You are not expected to be perfect, but you are expected to reasonably maintain the standard of care within your med spa.
